A trade mark can be any sign that is a graphic representation.

It can be, among others, a word, a drawing, a design or an ornament, a colour composition or a single colour, the form of goods or packaging, as well as a melody or another sound signal. Animated graphic elements, multimedia recordings or holograms are increasingly protected as trademarks.

A trademark can be registered for specified goods or services.

The Nice Classification is used to determine the type of goods and services for which a trademark is registered. The right of protection is granted for a period of 10 years. Before the end of this period, it is possible to apply for renewal for another ten years.

  1. Before filing a trade mark application, it is necessary to search Polish, EU and international registers. It is obligatory to check whether the same or similar trademark is registered for another entity.
  2. The next step is to prepare a draft application for protection involves deciding what type of mark is to be registered (word, figurative, word and figurative, spatial, design, colour, etc.). It is also necessary to determine for which goods and services the mark is to be protected. A person interested in registration should prepare information on the scope of their business activity (extract from the register of entrepreneurs of the National Court Register or the Business Activity Register, catalogues and trade offers, websites), trade names used by it and those used by its competitors.
  3. Before filing the application for a trademark, it is also necessary to grant a power of attorney.

How to register trademark and how much does it cost?

The costs and fees may differ depending on whether the trademark is filed for protection at the Polish Patent Office, the EUIPO or patent offices in other countries.

According to current regulations, in case of applying for trademark protection with the Polish Patent Office, a Client should pay the following fees:

  3. Preparation and submission of the application for registration of trademark should be added to the above fees.

The cost of representation in registration is determined individually

starting from 1500 PLN net.
